Pro-Huntsman group jabs at Romney in new ad (AP)

PORTSMOUTH, N.H. ? Republican presidential hopeful Jon Huntsman on Friday urged New Hampshire voters to stand up to the status quo and reject Mitt Romney, while a group of his supporters prepared a new television ad calling Romney a chameleon willing to do anything to get elected.

The $300,000 ad campaign is expected to begin running across New Hampshire this weekend, according to an adviser for the organization known as Our Destiny PAC. The adviser was not authorized to comment publicly.

"Two serious candidates remain," a voice says in the ad, which flashes images of Huntsman, the former Utah governor, and Romney, the former Massachusetts governor and front-runner in New Hampshire. "One willing to say anything, be anything. One who can actually do the job."

It continues: "One state can stop the chameleon. Vote Jon Huntsman."

Huntsman, who served as ambassador to China in the Obama administration, has not been anywhere near that pointed in his criticism of Romney. Speaking to employees at a Portsmouth software company Friday, he said Romney would be unlikely to change the "trust deficit" in Washington given that Romney has "half of Congress supporting him."

"Who's going to want to change anything when you've got the status quo supporting you?" Huntsman said. "You can have a candidate who's going to fight for change who is not going to be in the hip pocket of special interest groups, or you're going to have the status quo choice."

Former House Speaker Newt Gingrich also wouldn't do anything to restore trust in Washington, Huntsman said.

"Speaker Gingrich is not the kind of person who is going to be able to deal effectively with the trust issue because you can't deal effectively with the trust issue if you are a fixture of Washington, D.C., and have been for 40 years."

Huntsman, who is skipping Tuesday's Iowa caucuses, is betting his candidacy on a strong finish in New Hampshire's Jan. 10 Republican primary, which is open to independents as well as registered Republicans.

Huntsman entered the presidential contest with great expectations earlier in the year. But national polling suggests he's still largely unknown to many Republican voters. He's also struggled to raise enough money to pay for his own television advertising campaigns. On Wednesday, he told The Associated Press he's likely to leave the race unless he finishes in the top three in New Hampshire.

Pam Hicks, one of the software company workers, said she was 100 percent adamant before meeting Huntsman that she would not vote for him. After the event, Hicks said she was reconsidering although she doesn't like his anti-abortion views or his opposition to gay marriage, which is legal in New Hampshire.

"We believe nobody has the right to tell us how to live our lives," she said.

Still, Hicks said she planned to do more research on Huntsman.

"He needs a more serious look," she said.

In perhaps further proof that Huntsman's efforts in New Hampshire are paying off, voter Cynthia Ouellette echoed Hicks' sentiments hours later in Canterbury, where Huntsman attracted about 150 people to a town hall meeting. Like Hicks, Ouellette said she was sure she wasn't going to vote for Huntsman ? until she met him in person.

She described losing her teaching job because of budget cuts and grilled Huntsman about how he would be different from former President George W. Bush.

"He's the only one I've been able to meet, and I was impressed by his honesty and openness," she said.

Our Destiny PAC has now spent roughly $1.9 million on New Hampshire advertising to help Huntsman. That's more than any other outside group or other campaign has spent in the state, according to numbers obtained by The Associated Press.

Treasurys edge higher in light trading on Europe (AP)

NEW YORK ? Demand for U.S. government debt remained strong Thursday as yields on Italian government bonds stayed stubbornly high after the latest auction.

The benchmark 10-year Treasury note edged up 18.8 cents per $100 invested. Its yield fell to 1.90 percent from 1.93 percent late Wednesday.

Italy paid 6.98 percent on a 10-year bond auction, dangerously close to the 7 percent threshold at which Greece and Portugal had to seek bailouts from their creditors. That kept demand high for relatively low-risk assets like Treasurys.

In other trading the 30-year bond rose 37.5 cents. Its yield fell to 2.90 percent from 2.92 percent. The yield on the two-year note was unchanged at 0.27 percent.

The yield on the three-month T-bill was 0.01 percent. Its discount wasn't available.

Trading was quiet on the second-to-last trading day of 2011. Markets will be closed Monday in observance of New Year's Day, which falls on Sunday.

A while back I read a powerful testimony from a homosexual who was born again and repented from homosexuality and is now filled with peace and Gods Holy Spirit! The spirit of homosexuality will be CAST OUT sooner or later when Jesus enters the persons life.

Those who disagree with me are the ones that love and cherish the spirit of homosexuality and refuse to repent. Looking for a loophole in homosexuality wont work! There is none!

If Jesus comes into the life of a person, the Holy Spirit will drive out the spirit of homosexuality! both can't be in the same "temple" It may take time, but the spirit of homosexuality will be driven out sooner or later.

New Scientist 2011 holiday quiz

Caveman fashion, a giant of both science and literature, Trekkie dreams and much more in our end-of-year quiz

AS IS clear to anyone who possesses even the most cursory interest in the news, future historians will almost certainly mark 2011 as the year of the first robot-insect wars.

Robots were the aggressors, and they proved to be canny combatants, stealing strategies from the living world. Some adopted new forms based on the Venus flytrap that could fuel themselves on the flesh of insects (22 October, p 24). Indie Box Office: Wim Wenders' "Pina" opens big (omg!)

LOS ANGELES (TheWrap.com) - "Pina," Wim Wenders' 3D documentary about dancer-choreographer Pina Bausch, opened to an impressive $88,399 at three New York locations over the weekend, leading the specialty market.

The PG-rated movie, distributed by IFC films, had a per-location average of $29,466.

Angelina Jolie's directorial debut, "In the Land of Blood and Honey," struggled to attract moviegoers in its first days of release. Jolie wrote, directed and produced the R-rated love story set during the Bosnian war. Distributed by FilmDistrict, it opened at three locations and grossed $27,827 over the four-day holiday weekend -- a per-location average of $9,276.

"The film garnered great reviews and important editorial coverage for a recent war that was overlooked by many," Bob Berney, FilmDistrict's president, theatrical distribution, said in a statement. "Angelina has made a great directorial debut with this beautiful and brutal film that pulls no punches and features an amazing cast."

In its third week of release, Roman Polanski's R-rated "Carnage," from Sony Pictures Classics, expanded from five screens to seven, and grossed $88,216 -- a per-location average of $12,602. The movie has grossed $205,871 so far.

In wider release, Focus Features expanded "Tinker Tailor Soldier Spy" from 16 locations in its second week to 55 in its third. The R-rated movie, directed by Tomas Alfredson, grossed $1.2 million -- a $22,000 per-location average.

"Tinker Tailor Soldier Spy," an adaptation of John le Carre's espionage novel set in Cold War Britain, stars John Hurt, Gary Oldman and Colin Firth.

"It's just really satisfying a whole lot of moviegoers, making it the most in-demand specialized release in the marketplace," Jack Foley, Focus's distribution chief, told TheWrap Monday.

"The Artist," nominated for six Golden Globes, jumped from 17 locations in its fourth weekend to 167 in its fifth, averaging a solid $8,395 per house. The movie, directed by Michel Hazanavicus, grossed $1.4 million over the long weekend. It now has a total of $2.9 million.

David Glasser, the chief operating officer of the Weinstein Company, which released "The Artist," told TheWrap Monday that the company is pursuing "a very slow, methodical rollout and allowing audiences to see and enjoy this really beautiful picture."

Like with the Weinstein Co.'s Academy Award-winning "The King's Speech," audiences for "The Artist" are getting younger as the film moves into more theaters.

The Weinstein Co.'s other movie now in release, "My Week With Marilyn," had a softer weekend, grossing $888,000 while expanding from 244 to 602 locations in its fifth weekend. Its per-location average was $1,475. The movie, which stars Michelle Williams as Marilyn Monroe, has grossed $7.3 million so far.

Other holdovers include "Shame," Steve McQueen's NC-17 movie starring Michael Fassbender and Carey Mulligan. Fox Searchlight's film, now in its fourth week of release, dropped by one location, from 51 to 50, and grossed $191,000 over the weekend -- a per-location average of $3,604. It now has grossed $1.6 million.

Sony Pictures Classics' "A Dangerous Method," increased from 17 locations to 58, and grossed $292,230 over the weekend -- a per-location average of $5,038. It has taken in $1.1 million since its November 23 release.

Fox Searchlight's other movie, Alexander Payne's "The Descendants," dropped from 878 locations to 813 in its sixth week of release, and grossed $3.4 million -- an average of $4,213 per location.

The R-rated movie, which earned George Clooney and director Alexander Payne Golden Globe nominations, has grossed $33.7 million in its six weeks.

Church explosions in Nigeria kill at least 25

Radical Muslim sect claims bombs on Nigerian churches

A radical Muslim sect ramped up its wave of terror in Nigeria on Sunday with two deadly bombing attacks, including one that killed 25 during Christmas Mass at a Catholic church near the capital.

The sect known as Boko Haram, which has killed at least 491 people this year, claimed responsibility for the attack on St. Theresa Catholic Church in Madalla and also for the bombing of the Mountain of Fire and Miracles Church in Jos, where a police officer died during a subsequent gun battle.

A year ago, the sect claimed responsibility for a series of Christmas Eve bombings in Jos that left 32 dead and 74 wounded. The city of Jos is on the dividing line between Nigeria's predominantly Christian south and the Muslim north.

In Madalla on Sunday, rescue workers scrambled through the rubble of the church to save the injured. An angry mob around the bomb site was hampering their efforts.

"We're trying to calm the situation," said Slaku Luguard, a co-ordinator with Nigeria's National Emergency Management Agency. "There are some angry people around trying to cause problems."

A Boko Haram spokesman later phoned a Muslim newspaper to claim responsibility for the attacks.

In the northeastern city of Damaturu, several days of fighting between sect members and security forces has left at least 61 dead, authorities said Sunday. The police said two explosions struck the city Sunday, one near government offices.

Boko Haram has been campaigning for several years for the implementation of shariah law in Nigeria. Its members are scattered throughout northern Nigeria and nearby Cameroon, Chad and Niger.

On Friday, the U.S. Embassy in Nigeria's capital of Abuja issued a warning to American citizens to be "particularly vigilant" around churches and large crowds.

'Rare' brain disorder may be more common than thought, scientists say

ScienceDaily (Dec. 25, 2011) ? A global team of neuroscientists, led by researchers at Mayo Clinic in Florida, has found the gene responsible for a brain disorder that may be much more common than once believed. In the Dec. 25 online issue of Nature Genetics, the researchers say they identified 14 different mutations in the gene CSF1R that lead to development of hereditary diffuse leukoencephalopathy with spheroids (HDLS). This is a devastating disorder of the brain's white matter that leads to death between ages 40 and 60. People who inherit the abnormal gene always develop HDLS. Until now, a definite diagnosis of HDLS required examination of brain tissue at biopsy or autopsy.

The finding is important because the researchers suspect that HDLS is more common than once thought and a genetic diagnosis will now be possible without need for a brain biopsy or autopsy. According to the study's senior investigator, neurologist Zbigniew K. Wszolek, M.D., a significant number of people who tested positive for the abnormal gene in this study had been diagnosed with a wide range of other conditions. These individuals were related to a patient known to have HDLS, and so their genes were also examined.

"Because the symptoms of HDLS vary so widely -- everything from behavior and personality changes to seizures and movement problems -- these patients were misdiagnosed as having either schizophrenia, epilepsy, frontotemporal dementia, Parkinson's disease, multiple sclerosis, stroke, or other disorders," says Dr. Wszolek. "Many of these patients were therefore treated with drugs that offered only toxic side effects.

"Given this finding, we may soon have a blood test that can help doctors diagnose HDLS, and I predict we will find it is much more common than anyone could have imagined," he says.

Dr. Wszolek is internationally known for his long-term efforts to bring together researchers from around the world to help find cases of inherited brain disorders and discover their genetic roots.

Dr. Wszolek's interest in HDLS began when a severely disabled young woman came to see him in 2003 and mentioned that other members of her family were affected. The diagnosis of HDLS was made by his Mayo Clinic colleague, Dennis W. Dickson, M.D., who reviewed the autopsy findings of the patient's uncle, who had previously been misdiagnosed as multiple sclerosis, and subsequently, Dr. Wszolek's patient and her father. All members of the family had HDLS.

Dr. Dickson had identified other cases of HDLS from Florida, New York, Oregon and Kansas in the Mayo Clinic Florida brain bank and knew of a large kindred in Virginia with similar pathology, based upon a presentation at the annual meeting of the American Association of Neuropathologists. With concerted efforts, Dr. Wszolek and collaborators at University of Virginia were able to obtain DNA samples from the Virginia kindred. Dr. Wszolek also sought other cases, particularly those that had been reported in the neuropathology literature, and he was able to obtain samples from Norway, the United Kingdom, Germany and Canada, and other sites in the U.S. He and his team of investigators and collaborators have since published studies describing the clinical, pathologic and imaging characteristics of the disorder, and they have held five international meetings on HDLS.

In this study, which included 38 researchers from 12 institutions in five countries, the study's first author, Rosa Rademakers, Ph.D., led the effort to find the gene responsible for HDLS. Her laboratory studied DNA samples from 14 families in which at least one member was diagnosed with HDLS and compared these with samples from more than 2,000 disease-free participants. The gene was ultimately found using a combination of traditional genetic linkage studies and recently developed state-of-the art sequencing methods. Most family members studied -- who were found to have HDLS gene mutations -- were not diagnosed with the disease, but with something else, thus emphasizing the notion that HDLS is an underdiagnosed disorder.

The CSF1R protein is an important receptor in the brain that is primarily present in microglia, the immune cells of the brain. "We identified a different CSF1R mutation in every HDLS family that we studied," says Dr. Rademakers. "All mutations are located in the kinase domain of CSF1R, which is critical for its activity, suggesting that these mutations may lead to deficient microglia activity. How this leads to white matter pathology in HDLS patients is not yet understood, but we now have an important lead to study."

"With no other disease have we found so many affected families so quickly," says Dr. Wszolek. "That tells me this disease is not rare, but quite common." He adds, "It is fantastic that you can start an investigation with a single case and end up, with the help of many hands, in what we believe to be a world-class gene discovery."

The study was funded by a Mayo benefactor and the Mayo Foundation. Additionally, Mayo Clinic in Florida is a Morris K. Udall Parkinson's Disease Research Center of Excellence supported by the National Institute of Neurological Disorders and Stroke.

Libya marks 1st independence day in 42 years

(AP) ? For the first time in more than four decades, Libyans on Saturday celebrated the 60th anniversary of the country's independence from Italy and France.

Under Moammar Gadhafi's 42-year rule, the celebration was scrapped and instead, only the 1969 date of his coup was marked.

"Today we begin the building of Libya as our forefathers have done," Prime Minister Abdurrahim el-Keib said during the celebration. "We call on our sons to build Libya after its destruction."

His remarks were part of an official ceremony in the capital Tripoli. Thousands of people flocked to the capital from around the country in hopes of breaking bread on an 7-mile-long (11-kilometer-long) set of tables planned along Tripoli's coast as part of the ceremony. However, the dinner was canceled due to security reasons and infighting among former rebel groups who were invited, officials said.

At the National Transitional Council's headquarters in Tripoli, ministers shared a cake and mingled with journalists.

No family members of deposed King Idris, who were forced into exile in 1969, were in Libya for the ceremony. Idris died in Cairo in 1983.

Libya was occupied for decades by various nations, and it was not until 1947 that both Italy and France relinquished claims to parts of the country. The United Libyan Kingdom was announced with U.N. backing in late 1951 under King Idris.

"As the late King Idris said at the time, preserving independence is harder than achieving it," NTC chairman Mustafa Abdul-Jalil said at the ceremony.

On the sidelines of the ceremony, the prime minister told reporters that the Economy Minister Taher Sharkas had resigned due to health reasons.

The resignation comes after protests demanding that officials of the former regime be barred from serving in government.

Sharkas had been appointed to the same post by Gadhafi just two months before the longtime leader's capture and killing in October, a few three days before rebel fighters took over the capital, Tripoli.

His resignation also followed a Thursday announcement by Abdul-Jalil, in which he laid out 18 new ethics and standards guidelines for ministers in the new Cabinet formed after Gadhafi's ouster. One of the new guidelines is that a minister cannot have served in a top post under Gadhafi.

Protesters in the eastern Libyan city of Benghazi, where the anti-Gadhafi uprising broke out in February, have been protesting for nearly two weeks, demanding transparency and justice from the country's new leaders. They also called for Sharkas' ouster after it was discovered that Gadhafi appointed him as a minister on Aug. 18.

The new government has said it is open to some reconciliation with former regime officials, but protesters are opposed.

According to an NTC official, who wished to remain anonymous because he was not authorized to disclose internal policy, the prime minister is the one who chose Sharkas for the post. The official said it was a "sloppy" mistake and that el-Keib had not done enough research on Sharkas' background.

In his remarks at the independence ceremony, Abdul-Jalil admitted that the NTC made mistakes during the transition.

"We are not going to defend these mistakes, but it is on us as a national duty and responsibility to be transparent and learn from them so we do not repeat them," he said.

And so the cat & mouse game of tablet rooting continues. As one side moves to break security features, the other side moves to patch those flaws. ?Rooted PlayBook?owners want access to the hundreds of thousands of Apps available in the?Android Market; Research in Motion wants them to get those apps via?BlackBerry App World?- and not root their PlayBook.

In an effort to stymie?a certain CrackBerry blogger's?attempt to create a most awesome guide to adding the Android Market to your BlackBerry PlayBook, Research In Motion has addressed two major quirks in its Tablet OS. Perhaps I'm taking this too personally, but darn it, things were working fine Thursday.

In spending the majority of yesterday (and I'm not exaggerating on this) working on my guide, I discovered an interesting thing in?OS 2.0.0.6149. In a rather clever - almost devious - manner, RIM managed to cut off access to the Android Market by disabling the Accounts & Sync functions of the Android OS that runs on the PlayBook. If you managed to root your device on OS 2.0.0.4869; upgraded to 2.0.0.6149; and then tried to install the Market, a user would find him- or herself with a frozen Market application. You get one guess as to how I figured out that tidbit.

Also fixed sometime within the last 48 hours is OS 2.0.0.4869; it's not available anymore. A scant day ago, a user could sign up for the .4869 update from?one web page?and the .6149 update?from a second. With the .4869 update, a PlayBook owner could still root the tablet using the DingleBerry rooting tool. RIM fixed that; both websites now only allow .6149 to be installed to the PlayBook. If you haven't yet rooted your PlayBook, you're out of luck... for now.?

In the world of rooting, developers always hold one card close to the breast. Generally speaking, they won't release a rooting/jailbreaking tool unless they have another security hole to exploit. ?DingleBerry?3.0 is in the works and is said to include Hulu support and one-click rooting. It's anybody's guess when this cat and mouse game will escalate, and only time will tell whether it's worth the effort.

To tide fans over until then, a new series of preview clips give an early glimpse of the premiere night action. ?

House adjourns as Minority Whip vehemently protests [VIDEO] (Daily Caller)

In a scene reminiscent to the 2008 House Republican protest of the then-House Speaker Nancy Pelosi?s adjournment for the August recess, on Wednesday,?the House of Representatives GOP leadership adjourned until Friday, Dec. 23, with a vocal protest from Democratic Minority Whip Steny Hoyer of Maryland.

Hoyer took issue with the Republican adjournment before taking up a bill that would have extended the payroll tax break. On Tuesday, the House voted to send the payroll tax cut to a conference committee instead, where the members of the House and Senate will meet to resolve the issue. As Republicans left the room, Hoyer continued to speak:

SKorean president presses Japan on sex slaves (AP)

TOKYO ? South Korea's visiting president pressed his Japanese counterpart Sunday to resolve a long-standing grievance regarding Korean women forced to serve as sexual slaves during World War II, calling it a "stumbling block" in their relations.

Japan maintains that the matter was settled by a bilateral treaty in 1965 that normalized relations, and Prime Minister Yoshihiko Noda said he reiterated that stance during their meeting in the ancient capital of Kyoto.

Victims say they want compensation and the prosecution of wrongdoers.

President Lee Myung-bak said only 63 women who have identified themselves publicly as former wartime sex slaves are still alive, average age 86. He said 16 such women died this year.

"They could all die in a few years," Lee said, according to his spokesman Park Jeong-ha. "In such a case, (the issue) will remain a big burden the two countries cannot resolve ... We can only resolve (the issue) now."

"South Korea and Japan should become true partners for co-prosperity and regional peace and stability. For that, I think we need to have the genuine courage of resolving as a priority the issue of comfort women, which has been a stumbling block in relations between the two countries," Lee told Noda, according to a media pool report posted on the president's website.

The issue had gained renewed attention after protesters in Seoul placed a statue of a girl representing the victims in front of the Japanese Embassy on Wednesday.

The life-size statue of the girl, sitting on a chair in traditional Korean clothes, was unveiled to mark the 1,000th weekly rally for women forced to work in brothels for Japanese soldiers occupying the country. Several of the women joined the rally along with lawmakers.

Noda called the statue "regrettable" and said he asked Lee to remove it.

"Our nation's legal position on the issue of comfort women has already been settled," Noda told reporters. He added that Japan would continue to make efforts from a "humanitarian standpoint."

Lee said such a statue would have not been built if Japan came up with more sincere measures to resolve the issue, the presidential spokesman said.

Tokyo in 1995 initiated a fund of private donations as a way for Japan to pay former sex slaves without providing official compensation. But many comfort women have rejected the fund, demanding a government apology approved by parliament, along with compensation paid by the government.

Noda said the leaders also discussed speeding up the start of free trade negotiations.

Joe Simon, who co-created Captain America, dies (AP)

PHILADELPHIA ? Joe Simon, who along with Jack Kirby co-created Captain America and was one of the comic book industry's most revered writers, artists and editors, has died. He was 98.

Simon's family relayed word of his death Thursday, posting a short statement on Facebook and telling The Associated Press through a spokesman that the 98-year-old Simon died Wednesday night in New York City after a brief illness.

"Joe was one of a kind," said Steve Saffel of Titan Books, a Simon friend who worked with him on his recent autobiography, "Joe Simon, My Life In Comics."

Saffel said that Simon, born in Rochester, N.Y., in 1913, "lived life on his terms and created incredible things in the process. It was a privilege to know him and to call him my friend."

Among his creations was a partnership with comic book artist and illustrator Jack Kirby. The duo worked hand-in-glove for years and from their fertile imaginations sprang a trove of characters, heroes, villains and misfits for several comic book companies in their Golden Age of the 1940s, including Timely, the forerunner of today's Marvel Comics; National Periodicals, the forerunner of DC; and Fawcett, among others.

The characters the two created included the Newsboy Legion, the Boy Commandos and scores more, including Blue Bolt.

"Blue Bolt was the first strip Jack and I worked on together, beginning in 1940. He was a science fiction swashbuckler I created for Curtis Publishing, the company that put out the Saturday Evening Post," Simon told The Associated Press earlier this year. "They had decided to jump on the comic book bandwagon. Jack joined me with the second issue. Like Captain America, Blue Bolt got his powers from an injection, long before the baseball players were doing it."

For Timely, the duo created Captain America, debuting on the cover of "Captain America Comics" No. 1 in December 1940 with the champion of liberty throwing a solid right-hook at Adolph Hitler, an entire year before the United States entered World War II.

"Jack and I read the newspapers, and knew what was going on over in Europe. And there he was ? Adolf Hitler, with his ridiculous moustache, high-pitched ranting and goose-stepping followers. He was the perfect bad guy, much better than anything we could have made up, so what we needed was to create his ultimate counterpart," Simon told AP.

"Cap is one of the great comic book icons, and as dangerous as the world is today ? more than it was in the 1940s ? we need him around more than ever to act as our moral compass," Simon said.

Mark Evanier, a comic industry historian and Jack Kirby biographer, noted that Simon, besides being able to write and draw, also knew how to edit comics.

"Joe himself was the first great real editor who brought to comics skills he'd learned elsewhere and had some perception of how to put a magazine together and how to make a professional looking publication," Evanier told The AP on Thursday. "He had some business acumen. He knew how to talk to publishers, he knew how to make deals."

He also knew the market, Evanier said, noting that Simon, along with Kirby, plunged head first into creating horror, crime, humor and romance comics in the aftermath of World War II.

Simon said earlier this year that creating the romance comics was a high point for him and Kirby because they "negotiated to own half of the property," something that had been an uncertain prospect in the industry.

"I'd like to think that we showed today's comic book writers and artists how they can do more than just make a living producing comic books, and hold onto the fruits of their labors," he said.

Simon is survived by two sons, three daughters and eight grandchildren.

Jurors deadlock in $1B lawsuit against Microsoft

(AP) ? A federal jury on Friday failed to reach a verdict in a company's $1 billion antitrust lawsuit against Microsoft Corp. in a case so important to the computer giant that it put Bill Gates on the stand for two days last month.

Novell Inc. of Utah sued the software giant in 2004, claiming Microsoft duped it into developing the once-popular WordPerfect writing program for Windows 95 only to pull the plug so Microsoft could gain market share with its own product.

Novell says it was later forced to sell WordPerfect for a $1.2 billion loss.

The trial began two months ago with jurors getting the case on Wednesday. After much confusion, and some perplexing questions from the panel, they told U.S. District Judge J. Frederick Motz they were deadlocked by early Friday evening.

He repeatedly asked them if they could keep trying.

"This has been a very long and expensive case," Motz told the panel.

Novell attorneys pleaded with Motz to give the panel just one more day. In the end, however, the 12 jurors told the judge they were "hopelessly" deadlocked, and they later told lawyers a single holdout refused to vote in Novell's favor.

"He had strongly held views about the technical evidence and refused to budge," Novell attorney Jeffrey Johnson said. Jurors offered no comment after the trial.

Novell was left with little to show for a decade of effort, but the company said it will seek to retry the case with a new jury.

"Although it's a technically complicated case, we're hoping to convince another jury that our claims have merit," Novell's corporate counsel Jim Lundberg said.

Microsoft said it would file a motion asking the judge to dismiss Novell's complaint for good and avoid a second trial.

"We remain confident that Novell's claims don't have any merit and look forward to the next steps in the process," said Steven Aeschbacher, Microsoft's associate general counsel.

Novell waited until 10 years after Microsoft left WordPerfect behind to file the lawsuit. The company said it was waiting for the U.S. government's antitrust enforcement against Microsoft to wrap up. At first Novell's case was dismissed, but it was later reinstated on appeal.

Microsoft lawyers have argued that Novell's loss of market share was its own doing because the company didn't develop a compatible WordPerfect program until long after the rollout of Windows 95. WordPerfect once had nearly 50 percent of the market for word processing, but its share quickly plummeted to less than 10 percent as Microsoft's own Office programs took hold.

Gates testified last month that he had no idea his decision to drop a tool for outside developers would sidetrack Novell. Gates said he was acting to protect Windows 95 and future versions from crashing.

He said that the company's preferred Word software was superior to WordPerfect, which was a "bulky, slow, buggy product" that did not integrate well with Windows 95.

Novell could have worked around the problem but failed to react quickly, he said.

Novell has argued that Gates ordered Microsoft engineers to reject WordPerfect as a Windows 95 word processing application because he feared it was too good.

Novell's lawsuit is the last major private antitrust case to follow the settlement of a federal antitrust enforcement action against Microsoft more than eight years ago.

Novell is now a wholly owned subsidiary of The Attachmate Group, the result of a merger that was completed earlier this year.
